EFFECTIVE IMMEDIATELY - Although we accept them, we do NOT recommend payment by check. We will hold ALL checks for a period of 14 DAYS. Personal checks, 'Bank' checks, cashier's checks, Money Orders, etc, will all be treated the same. Exception: Items paid for with US Postal Service Money Orders will ship immediately. This is a highly recommended method of payment. Our Policies: Important: These policies are considered to be part of every auction and any other eBay transactions we offer. We really regret the length of these policies but they have become necessary to ensure that the customer understands their rights and responsibilities.Unless specifically noted, new bindings when included with a ski or snowboard package are shipped unmounted. The customer must arrange for mounting of ski bindings by a certified mechanic or is responsible for learning how to mount snowboard bindings properly. Ski/binding packages CANNOT be used immediately upon delivery. Return Policy: Satisfaction Guarantee. On most items, you have THREE DAYS after receipt of your item to notify us that you wish to return the item if you find it unsatisfactory for a full refund of your purchase price. We will issue a refund by check within 5 days of return of the merchandise or by Paypal if that's how you paid. Merchandise must be returned in the same condition as shipped. Merchandise we specifically advertise as "closeout" or "clearance" is NOT RETURNABLE unless otherwise stated, and is thus priced accordingly - such items will NOT display the Satisfaction Guarantee notice. **** Please note that in order to be "dissatisfied", the customer must actually receive the merchandise. This policy shall not be abused to "cancel" an auction should a customer choose not to pay after an auction has ended. In that event, we will use eBay's standard procedures and report the auction as unpaid. **** Return instructions: In the event you wish to return merchandise, the bidder must contact us for an RMA number before returning merchandise. The merchandise must be returned in the same condition that it was shipped and shipped so that we may reasonably expect to receive it within 14 days of issuing the RMA. Once the customer has bindings mounted, skis may not be returned. Pre-mounted ski/binding combinations are returnable so long as they have not been altered or used. Merchandise cannot be returned after it has been used or altered and defects must be brought to the attention of Wintersales prior to any modification. Wintersales reserves the right to inspect the merchandise prior to issuing a refund. Bidder is responsible for return shipping. Shipping charges are not refundable. Exception: Of course, if it is our error and you get something that is significantly different than advertised or agreed upon (e.g. wrong size, different model, mismatched pair, etc.), it may be returned at our expense for replacement or refund with no restocking fee (and our apologies). We will send you by email a return shipping label. Subjective issues of fit, texture, or "feel" are not grounds for a shipping charge refund. Shipping-damaged or lost merchandise must go through the shipper's claim process. Merchandise returned up to 30 days late is subject to a 20% restocking fee. Merchandise returned more than 30 days after we issue an RMA or returned without authorization is not eligible for refund and will be held until the owner makes arrangements to have it shipped back While we encourage you to contact us, manufacturer's defects must be addressed through the manufacturer. The manufacturer is the sole authority for determining warranty service. In most cases, we do not purchase directly from the manufacturer and cannot process warranty service for you. **** Please note: due to computer hardware differences, digital pictures are seldom "true to life" color. Merchandise color shade may vary slightly from pictures provided. If exact color is important (e.g. periwinkle is different from light blue), email us first. Payment: Payment is due within 7 days of notice of the succesful conclusion of an auction. The forms of payment accepted are listed in each auction and the conditions for acceptance is considered to be part of the agreement. If a bidder's payment is late, we reserve the right to relist the item for sale without futher notification. We accept checks, money orders, and credit card payments through Paypal. We do not directly accept credit cards for mail order or internet sales. If you pay by PayPal, we will ship only to the address authorized by PayPal. If the customer wishes another delivery location or cannot get PayPal to authorize the preferred address, please pay by check or money order. Please note, to comply with Paypal policies, we require a signature for delivery on all shipments with a total payment (including shipping) over $250. Shipping Policy: Wintersales ships a cost listed in each auction or as calculated by the on-line calculator within the auction listing. Shipping costs are generally not negotiable and are based on actual transportation charges plus a nominal fee ($1-$3) to cover packing materials. Please note that most skis and other long and tall merchandise usually ships as oversize and is billed as if it weighed 30 or more lbs. Flat rate costs are averaged for shipments across the country and may be more or less than the actual shipper's charges. We will combine items and shipping charges when more than one item is purchased if they can fit in a single box. Wintersales has an excellent reputation for shipping on time, however, we do not guarantee transit times - the shipping service alone makes such guarantees if available. Remedies for the consequences of failure to deliver on time are limited to those offered by the shipping service and Wintersales will not be responsible if we delivered the package to the shipping service on time. Wintersales is not responsible for circumstances beyond our control which may delay shipping. In the event a package is damaged, lost, or misdirected by the shipping service, an insurance claim must be filed and paid to us prior to item replacement if the item is available or a refund if not available. All information provided in the listing comes from the manufacturer or other professional publications and does not constitute specific recommendations on the part of Wintersales, Inc. The bidder is responsible for determining suitability for his/her use. Use of this merchandise for other than its intended use constitutes abuse and no warranty will be honored.Sales Tax: The State of Massachusetts requires us to collect sales tax on shipments within the state. I hereby unconditionally release from any and all liability and agree not to sue, to indemnify and hold harmless Wintersales Inc, their representatives, agents, affiliates, partners, officers, directors, and employees (collectively hereinafter "Wintersales") of and from any claims for damage, injury or death to myself, or to any person or property, arising out of, or in connection in any way with my participation with the sports of skiing, snowboarding, golf, or any other sporting activities with equipment or accessories purchased from Wintersales. I have read and I understand this agreement and all of its terms. I am entering into this agreement freely and voluntarily and I agree that it is and shall be binding on me, my heirs, assigns and legal representatives. I understand that I am entering into a legally binding sales contract with an explicit stipulation not to sue Wintersales except for gross negligence and intentional misconduct. I further agree that any claim or suit that I may bring for any reason against Wintersales shall be submitted to the jurisdiction of the state or federal court in the state in which Wintersales is located and no other jurisdiction and shall be governed by the laws of that state. I agree that if any portion of this agreement is determined to be unenforceable by a court of law, all other parts of the agreement shall remain in full force and effect. WE DISCLAIM ALL REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, MADE TO YOU OR ANY OTHER PERSON, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES REGARDING QUALITY, SUITABILITY,MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE OF ANY SERVICES OR ANY GOODS PROVIDED, AS ALLOWED BY LAW.
