Note to customers. As you know, legal terms can be harsh in their attempt to be lack and whitewhen resolving issues. In fact, Ie found that 99.9% of the time, legal terms and conditions are unnecessary. Unfortunately, for you 99.9%, there is that 0.1% for which I must have these T and C. So don be put off by the policies and terms Ie set forth. I have never yet had a customer walk away mad with an unresolved issue. Ie had packages lost by UPS, broken by USPS, etc. thappens. In the worst case, customers, and I, have been disappointed at the loss of an irreplaceable item. But no one should walk away from the transaction feeling ripped offnd no one does. So enjoy your bidding/shopping experience and feel secure that we can work through any issues that come up.
Terms and Conditions of Sale
This document outlines the terms and conditions of sale between Denny eDeals aileeand auction bidder/winner uyer
By bidding on this auction, Buyer agrees to the terms and conditions listed below and on my bout Mepage.
Guarantee
All items will ship as described. Please read description carefully as all items are sold S IS All issues/complaints must be communicated within one (1) week of shipment. Returns will be accepted only if the item was not as described in the auction. Buyer must ship returns back and item must be received in "as shipped" condition. Shipping charges are not refundable.
I will do my best to describe the item(s) for sale as accurately as possible. That includes describing any obvious flaws and/or generally anything that would result in buyer remorse. As a habit, I am usually very conservative in my descriptions and/or gradings. This methodology may result in slightly less profit for me but hopefully greater customer satisfaction, good feedback, and continued patronage.
Payment
Buyer agrees to remit payment within seven (7) days of auction close. Acceptable payment methods include PayPal, credit card, cashiers check, or money order. Buyer agrees to contact seller via email within three (3) days of auction close (receipt of electronic payment will suffice as contact requirement). Bailee reserves the right to re-list/resell items if contact is not made within four (4) days from auction close.
If after three (3) days, from auction close, I haven heard from you, I will send you a Payment Reminder. Again, communication is the key. When you get this, acknowledge it with an email and time frame for payment.
Subsequent to the Payment Reminder, if another twenty-four (24) hours elapses without a response, I will file a Non-Paying Bidder form with eBay. This means you will get another reminder from eBay. From what Ie seen, these are very polite reminders and should not offend.
At the point where I am forced to file a Non-Paying Bidder Report, I reserve the right to re-list the item for sale or make an offer to another bidder for the auction goods. If such an offer is made, I will honor the first payment received. It is very rare that a transaction degrades to this level and this degradation can be stopped with a simple email.
Ten (10) days after filing a Non-Paying Bidder Report, I will request a Final Value Fee Credit with eBay. This will refund me commissions already paid, by me, to eBay, for your goods. It may also result in your suspension from eBay.
Now if all this sounds harsh, just remember that at least fourteen (14) days has passed since the auction ended and the winning bidder has not contacted me in any way.
Most of my auction business is done on a onsignmentbasis. This means that once an auction ends successfully, I have two customers: the buyer and the seller. The buyer expects safe delivery of the goods in a timely manner and the seller expects delivery of the proceeds of the sale ($) in a timely manner. Obviously, the fastest path to satisfaction of both parties is PayPal. However, I do not want to eliminate buyers from being able to send in cashiers checks or money orders. Many people prefer this method for various reasons. I tell you this in hope that whatever your payment method is, you will pay for your goods in a reasonable time frame. I also understand that sometimes circumstances are such that payment can be delayed. When this is the case, please let me know your circumstances. I am a reasonable individual and will make every effort to complete the transaction with you. What I cannot do is guess why you haven paid or contacted me. Therefore I have put the following rules into place for all buyers:
Upon auction close you will most likely receive a notification from eBay and one from PayPal which will give you the opportunity to pay and/or contact me with any payment questions. If you choose to pay with a cashiers check or money order, please use this opportunity to send me a quick email and let me know that a check is on its way. Please also let me know the approximate time frame to expect the check.
Shipping
Bailee agrees to ship orders within the United States and Internationally upon prior request. Buyer wishing to receive goods in an international location shall email Bailee for approval prior to bidding. All orders will be shipped via USPS, UPS, or FedEx at seller discretion.
It is not my intention to profit from shipping as some other sellers do. I hate it when an item sells for $0.01 and ships for $20.00! It just wrong. I will estimate shipping charges as accurately as possible. I also recycle boxes so as to keep shipping costs down. However, every once in a while I have to purchase a box. There also the occasional trip to the store for bubble wrap, tape, labels, business cards, etc. So if Ie charged you $5.95 S & H and your postal label says $4.05, don get bent out of shape. It more likely to go the other way where it eating into my profits and remember had to stand in line at the post office. If that's not worth a couple of bucks, I don know what is.
Items listed as "Local Pickup Only"
Buyer agrees that item will be picked up within 10 days of auction close. After 10 days, unless Bailee has agreed, in writing, to hold item for an additional time period, item is no longer the responsibility of Bailee to hold. Item may be resold, relisted, or simply discarded. No refund is guaranteed and any refund, at Bailee's discretion, will be limited to the Bailee's commission less any eBay and PayPal fees which shall include every listing for said item, including relistings prior to Buyer's winning auction and relisting after 10 day pick up period.
Insurance
It is the policy of Bailee to send every shipment with insurance coverage at Buyer's expense. It is the responsibility of the Buyer to cooperate with and deliver proof to the shipping carrier. If Buyer chooses not to purchase insurance or insurance is not available to Buyer's location, Buyer assumes all responsibility for any loss or damage to purchased item. No refunds will be given on damaged or lost items where Buyer has chosen or directed Bailee not to purchase insurance. No refunds will be given on damaged items where Buyer has not retained proof of damage to provide to shipping carrier.
Legal
Denny eDeals is not the owner or seller of these goods, but rather a bailee acting on behalf of the seller to facilitate the sale of the goods by holding the goods until such time as a sale is completed and the good are shipped to the buyer.
Denny eDeals warrantees and represents that the goods are as they are described in the above listing. We will accept returns of the goods only if they fail to meet the description above. Denny eDeals specifically disclaims any implied warranties of title, merchant-ability, fitness for a particular purpose and non-infringement.
Denny eDeals entire liability to you or any third parties under any circumstances is limited to the sales price of the relevant goods.
