We wish to ensure that customers will receive only authorized and licensed MOMO products sold by MOMO authorized dealers and distributors who have invested time and money in promoting and servicing MOMO products.

 

We also monitor Ebay for the illegal use of our images in auctions. Use of our images is restricted on Ebay only to MOMO authorized Ebay sellers.

 

If you received an email about your auction, or your auction was removed by the Ebay VeRO (Verified Rights Owners) program, your auction violated one of the following most common trademark or distribution infringements:

 

1. Image used in auction is copyright by MOMO.

 

2. Item is not a MOMO product but has MOMO logo or name. This includes auctions, which specify that the non-MOMO item “fits MOMO …” in the title of the auctions.

 

3. Item is not a MOMO product but has the MOMO trademark in the description and/or title of the auction. This includes auctions using qualifiers such as “not”, “like”, “style”, etc.
   
   
4. Item is offered as new and for sale by a seller located outside of the United States for sale to the United States. MOMO USA is the only authorized importer of MOMO products and we do not allow the sale of “grey market” items in the U.S. MOMO USA is owned by MOMO Italy, which is owned by Dallas Texas based Carlyle Management Group. Because a U.S. company owns the MOMO company and trademark, we may have additional rights above and beyond normally afforded to foreign companies and trademark holders.
   
   
5. Item is offered as new by a seller located outside of the United States but the item is not legal or licensed by MOMO for sale in the United States.
   
   
6. Item is offered as new by a seller located in the United States, but the seller did not purchase the item in the U.S. Some personal items may be excluded as long as the auction does not mislead bidders in believing the seller is a MOMO dealer.

There are also many companies that have received permission to use the MOMO logo on die cast collectables, model cars, etc. We try to monitor these listings but because the licensing for the use of these logos can come from a large number of authorized sources, we generally will only ask Ebay to remove a listing if we know the item being sold is 100% fake. Sometimes a seller will use a plain car (ie. Ferrari 360 in red) and use a common decal pack (ie. Ferrari 333 Daytona 24 Hour Winner or homemade decal pack) and apply the decals to the car and offer it as a rare collectable. These types of combinations we will remove from Ebay as they are not authentic and generally misleading, even if part of the product is officially licensed. Decal packs are usually licensed for use on the original car model and not for distribution or creation of other models. BEWARE: If you see a car design or decal pack that you have never seen before, make sure it is truly authentic. When in doubt, ask the seller for the original manufacturer of the model or decal pack and try to contact them to verify authenticity.

 

ADDITIONAL NOTES FOR U.S. BUYERS:

MOMO Italy may also offer products for sale outside the U.S. that are not legal in the U.S., ie. Safety harnesses, racing helmets, etc. Most Ebay sellers that offer such products are MOMO dealers located outside of the U.S. and buyers will have to deal with the company located outside the U.S. for any problems or disputes. MOMO USA cannot offer you any help with these products. MOMO USA does try to eliminate Ebay listings that offer these products for sale into the U.S., but we do miss some listings and some sellers may sell these items into the U.S. even when the auction states otherwise. You will not have any warranties, service, or parts available for these items if you choose to purchase them. U.S. MOMO authorized dealers are prohibited from selling these items, however, there are some new in a box old stock items being sold by individuals and those are likely legitimate items, however, any problems or issues with these products must be directed to the seller, not MOMO USA.

 

Under the MOMO Design name many other products are available in Europe and Asia but these items may not be DOT legal (such as motorcycle helmets) or intended for U.S. distribution. Most Ebay sellers that offer such products are MOMO Design dealers located outside of the U.S. and buyers will have to deal with the company located outside the U.S. for any problems or disputes. MOMO USA cannot offer you any help with these products. BEWARE: Automotive car products using the “MOMO Design” logo are likely fake products. MOMO Design is a separate marketing company from MOMO Italy and does not produce any automotive products. JDM (Japanese Domestic Market) MOMO steering wheels are very popular on Ebay. These steering wheels were designed for the OE (Original Equipment) market and are licensed by MOMO Italy to be included in many cars available in Japan and other foreign markets. The steering wheels often include airbags or other features not found on U.S. versions of the same car. MOMO USA does not have any parts, instructions, installation kits, etc, available for these items. These are OE products for foreign market applications and MOMO USA only provides service to aftermarket products sold in the U.S. through its authorized dealer network. In case of problems you will need to deal with the seller or foreign OE manufacturer (Honda, Subaru, etc) in Japan (or other foreign market). BEWARE: The products may not conform to U.S. DOT standards, may not operate the same as in the original OE application, and are usually used (often removed from a crash damaged vehicle). MOMO USA cannot legally stop the sale of used parts into the U.S. from foreign markets, but we can stop new products and try to eliminate any auctions offering new OE products from foreign markets. However, if we miss a new OE product from a foreign market, you still will not have any service, support, or warranty in the U.S.

 

There are a number of Ebay sellers that offer MOMO marine steering wheels for sale. MOMO licenses the brand name to use on boat/marine steering wheels to a separate company (Uflex – see above) and MOMO USA offers no support or parts for them. Some Ebay listings may include automotive products such as horn buttons or hubs. We cannot legally control that marine items are sold with automotive products as long as the marine items are described as marine products. BEWARE: Marine steering wheels were not tested with the use of our automotive hubs and did not pass automotive crash tests.

 

Through the years MOMO USA or MOMO Italy discontinued products for market, legal, or certification reasons. Some products are only discontinued in the U.S. and may still be available outside the U.S. The most common discontinued items found on Ebay are Horn Buttons, some Wood Steering Wheels, and Safety Harnesses. These items are often offered as new by non-MOMO dealers or by individuals who purchased large quantities of old stock from a distributor or dealer. U.S. authorized MOMO dealers are generally not allowed to sell these items. As long as the item is as described, these sellers can sell this product on Ebay, but you should be aware that these items are no longer supported by MOMO USA as we do not have any replacement parts. BEWARE: It appears thousands of authentic MOMO horn buttons are still in circulation and include the MOMO name embossed on the back of the button. However, horn button faces are easily changed and some horn buttons may include brand new faces with logos by Porsche, Ferrari, etc. which may be fake and are offered for unusually high prices. There is no way for MOMO USA to verify the authenticity of the faces and the seller of these items is ultimately responsible for the authenticity of the product.

 

Ebay contains an eclectic collection of MOMO branded lifestyle merchandise (T-shirts, bags, key chain holders, pins, banners, stickers, etc.) Many of these items are no longer in production but are still legal to sell on Ebay, because they were officially licensed products. Unfortunately, there is no one way to tell if the item is authentic except for looking at the history of the seller. We monitor this segment very closely and generally catch the fake products and have them removed. However, you should check the feedback of any seller before bidding on the item. If the seller has a history of selling these kinds of products with the MOMO name, he is very likely selling authentic merchandise. BEWARE: Many sellers with fake products have good feedback ratings but the items they sold did not include our brand name but probably included many other well-known brand names, including major automotive manufactures. Unfortunately not all manufacturers defend their trademark name as vigorously on Ebay as we do and small operations on Ebay often flourish selling fake products. If a seller offers many other products of the same kind (ie. T-Shirt with brand name logo, stickers, etc.), but you don’t see a history with our brand name, it is very likely a fake product. You should also look at the location of the seller, as many of them are located outside of the U.S.
